Do I need HOA approval to build a fence in Houston?
If your property is in an HOA, almost certainly yes — and you need it before the fence goes up, not after. Nearly every deed-restricted community in the Houston area requires written approval from an architectural control committee before any fence is built, replaced or changed, and that includes replacing a fence like-for-like with the same thing that was already there.
The important thing to understand is that this is separate from, and usually stricter than, the city. Houston generally allows up to 8 ft in a back yard away from a street; plenty of HOAs cap it at 6. Where the two disagree, the tighter rule is the one you have to build to. Clearing the city tells you nothing about clearing the association.
What HOAs actually check
The rules differ community to community, and you have to read your own — but after fifteen years on this coast, these are the five that come up almost every time:
Height. Commonly capped at 6 ft, sometimes lower on a corner lot or where a fence faces a street or green space.
Material. Often a named list. Cedar and pine are usually fine; vinyl is sometimes required and sometimes prohibited; chain link in a front or side yard is frequently banned outright.
Colour and stain. Some communities require natural weathering, some require a specific stain, some forbid painting entirely.
Which way the fence faces. Many require the finished side — pickets out, rails in — to face the street or the neighbour. This one catches people, because it changes how the fence is built rather than what it is made of. A shadowbox sidesteps the argument by looking finished from both sides.
Setback and placement. Where the fence may sit relative to the property line, easements, and any common area behind you.
The approval process, and how long it really takes
Find your deed restrictions and architectural guidelines. They are usually on the management company’s portal. If you cannot find them, email the manager and ask — do not rely on what a neighbour did.
Submit a plan. Typically a plot or survey drawing marking the fence line, plus the height, material, style and stain. We supply the drawings and the spec as part of the quote.
Wait for the committee. Most meet monthly, and many allow 30 days to respond. Two to six weeks is the realistic window, and it is the part of the project people do not budget time for.
Get it in writing and keep it. A verbal yes from a board member is not an approval, and it will not help you if the committee changes.
The single most expensive mistake here is ordering material against a plan that has not been approved. Cedar cut to a 6 ft spec does not become an 8 ft fence, and a rejected colour means re-staining a finished run.
Why plans get rejected
Too tall for the community, or for that particular lot.
Wrong material — chain link where it is not permitted is the most common single rejection.
Rails facing out where the guidelines require the finished side to the street.
Placement over an easement, across a drainage route, or further forward than the restriction allows.
Three of those four are decided before anyone digs, which is why we would rather spend twenty minutes on your guidelines than have you spend two thousand dollars twice.
HOA rules are not the only rules
Approval from the association does not replace the city, the utilities or the survey. You still need to:
Check the city height limit and any corner-visibility rule. League City, for example, requires fences near certain intersections to be 70% open regardless of what the HOA says.
Confirm whether a permit applies — usually not for a standard-height residential fence, commonly yes for taller builds, masonry and floodplain addresses.
Call 811 before anyone digs. Free, and required in Texas.
Know where your property line actually is. Build fully on your side.

Do I need HOA approval to replace an existing fence?
Usually yes, even for a like-for-like replacement. Most architectural guidelines cover any new, replaced or altered fence rather than only new construction. Check your own restrictions — assuming it is exempt is how people end up rebuilding.
How long does HOA fence approval take in Houston?
Two to six weeks is realistic. Most architectural committees meet monthly and many allow themselves 30 days to respond. Build that into your timeline; the fence itself is one to three days.
What if the HOA and the city disagree on height?
The stricter rule governs. If the city allows 8 ft and your HOA caps it at 6, you build to 6. Clearing one does not clear the other.
Can my HOA make me take down a fence?
If it was built without approval or outside the guidelines, yes — associations can require modification or removal, at your cost. That is the whole reason the approval comes first.
Which side of the fence has to face my neighbour?
